The Legal Foundation
Before you can sign anything, you need two things:
- NIF (Número de Identificação Fiscal): Your Tax Identification Number. You cannot buy a coffee machine contract without one, let alone a house.
- Local Bank Account: While not strictly mandatory by law, it is practically essential for paying taxes, utilities, and getting a local mortgage.
Property Due Diligence
Never skip the paperwork check:
- Certidão de Teor (Land Registry Certificate): Proves who owns the property and if there are any liens or debts attached to it.
- Caderneta Predial (Tax Booklet): Verifies the tax situation of the property and its fiscal value.
The Financial Commitment: CPCV
The Contrato de Promessa de Compra e Venda (CPCV) is the Promissory Buying and Selling Contract.
- Deposit: Usually 10% to 20% of the purchase price.
- The Risk: If you back out, you lose your deposit. If the seller backs out, they must pay you back double the deposit.
The Final Act: Escritura
The Escritura (Public Deed) is signed in front of a Notary. This is when the remaining balance is paid, and the keys are handed over. The notary then registers the transaction with the Land Registry.
